Terms of Use for Mapping on Open Hamilton Your use of mapping on this website and the contents therein indicates your acceptance of these terms and conditions. If you fail to comply with the terms and conditions below when using mapping on Open Hamilton, your right to use will end automatically. Your Use of Mapping: The City of Hamilton grants you a non-exclusive, non-transferable limited licence (the “Licence”) to display on your computer, print, and download and use all mapping contents on Open Hamilton (the “Site Product”) solely for personal, educational, or non-commercial purposes. You acknowledge and agree that this Licence does not give you a copyright or other proprietary interest in the Site Product and that you only have a limited right to use mapping. Unless otherwise specified you may not copy, modify, publish, translate, adapt, distribute or otherwise use the Site Product in any medium, mode or format for any lawful purpose. You must ensure that your use of the Site Product does not breach or infringe any applicable laws. No Endorsement. This Licence does not grant you any right to use the Site Product in a way that suggests any official status or endorsement from the City of Hamilton. No Warranty: You get NO WARRANTIES, none of any kind. The Site Product is licenced “AS IS” and “AS AVAILABLE”, and the City of Hamilton excludes all representations, warranties, obligations and liabilities in relation to the Site Product, to the maximum extent permitted by law. The City of Hamilton is not liable for any errors or omissions in the Site Product and will not, under any circumstances, be liable for any direct, indirect, special, incidental, consequential, or other loss, injury or damage caused by its use, even if specifically advised of the possibility of such loss, injury or damage. The City of Hamilton does not guarantee the continued supply of the Site Product and may add, delete or amend the Site Product at any time. Maintenance of Mapping: You acknowledge the City of Hamilton and its suppliers are not required to provide any updates, fixes, new versions, new releases, maintenance and /or support of any kind for the Site Product. Links to External Sites: Links to external websites posted on Interactive Mapping contain information created, published, maintained, or otherwise posted by institutions or organizations independent of the City of Hamilton. The City of Hamilton does not endorse, approve, certify, or control external websites and does not guarantee and warrantee the contents therein. Cancellation: The City of Hamilton may, in its sole discretion, cancel or suspend your access to mapping without notice and for any reason, including anything which the City of Hamilton, in its sole discretion, believes is a breach of this Licence or is otherwise unlawful or harmful to others. In the event of cancellation or suspension, you will no longer be authorized to use the Site Product and mapping, and the City of Hamilton may use any means possible to enforce its decision. Legal proceedings related to this Licence may only be brought in the courts of Ontario sitting in Hamilton.
